MUNACA Strike - AMUSE’s Solidarity
Dear members of AMUSE,
MUNACA has provided Strike Notice to McGill. If negotiations do not improve, they will be in a legal strike position starting Thursday September 1, 2011 at 6AM.
For our members it is important to note the following:
According to the Quebec Labour Code section 109.1, the employer cannot utilize the service of a person whose bargaining unit is legally on strike or utilize the service of a person to perform the duties of a member of a bargaining unit who is legally on strike.
For the membership of AMUSE/AMURE, it means that you must still continue to do your work, as usual, for McGill. But what McGill cannot do, is to ask our members to do the duties of MUNACA members. If you think that it’s the case, you can politely refuse to do this work. If the employer insists, we strongly suggest that you advise AMUSE/AMURE so it can take proper action.
If you are usually performing part of the task of or with a MUNACA member, it means that you must continue to do you work but your workload must not be irregularly overloaded. Also, if you think that’s the case, we strongly suggest that you advise AMUSE/AMURE so it can take proper action.
If you show up to work and there’s a picket line in front of your workplace, you don’t have to put up fight with picketers to insure that you get to work. It’s the obligation of the employer to insure that proper safety measures are in place so you can enter is premises safely.
If you face a picket line, we suggest that you show support to our co-workers and find the nearest phone. You should call you supervisor, telling her/him that you are available for work, near your work place, but that you fear for your safety as there are picketers in front of your building. McGill’s obligation will then be to make sure that you can come to work in a safe manner and will have the obligation to pay you since you are available for work, near your work place and waiting for instructions as to how to get into the premises safely.
We support MUNACAs legal right to strike. We know all of the sacrifices that MUNACA makes to gain equitable working conditions at McGill will have a positive impact for all members of the McGill Community.
